BY CHECKING THE TERMS
AND CONDITIONS BOX, I INDICATE THAT I HAVE READ AND UNDERSTAND
THE BUYERS AGREEMENT AND AUTHORIZATION CONDITIONS OF ORDER
AND/OR SALE AND LIABILITY CLAUSE.
Buyer’s Agreement
and Authorization
I am the authorized buyer of the mentioned firearm(s). I authorize
the dealer to order the mentioned merchandise. I will adhere
to the payment terms and realize that cancellation of the
order or non-payment of the total amount due could result
in the loss of all or part of my deposit to cover reasonable
expenses incurred by the Dealer. I have read and agree to
the “conditions” below.
Conditions of
Order/and or Sale
All Firearms and Ammunition Sales are final and no refunds
or exchanges are permitted. Any defective new firearm under
manufacturer warranty will be returned to the manufacturer
for repair or replacement at the manufacturer’s discretion,
and at customer’s expense. No merchandise may be returned
without prior authorization. Returned items or Non-Approvals
for individuals are subject to shipping charges, and a 35%
restocking fees and less any transfer fees. We are not responsible
for maintaining any of your personal firearms records for
you. It is recommended that you record the information about
your firearm and maintain that for future reference. All used
firearms are sold on an “AS-IS” basis and should
be checked by a competent gunsmith.
Special order and/or custom
items may require a deposit, which will usually, but not always,
be noted in the item’s description.
Liability Clause
ALL FIREARMS ARE CLASSIFIED AS DANGEROUS WEAPONS. THIS WEBSITE,
THE WEBSITE OWNER, AND/OR THE DEALER CANNOT BE HELD LIABLE
AND/OR RESPONSIBLE FOR ANY PHYSICAL INJURY, DEATH AND/OR PROPERTY
DAMAGE RESULTING DIRECTLY AND/OR INDIRECTLY FROM EITHER THE
INTENTIONAL AND/OR UNINTENTIONAL DISCHARGE OF A FIREARM(S)
AND PROPER HANDLING OR FUNCTIONING OF A FIREARM(S),
PARTS, ACCESSORIES, OR AMMUNITION.
WARNING: You may not receive
a firearm if prohibited by Federal or State Law. The information
you provide will be used to determine whether you are prohibited
under law from receiving a firearm. Certain violations of
the Gun Control Act are punishable by up to 10 years imprisonment
and/or up to a $250,000 fine.
We do not ship firearms directly to you.
They are sent to your local FFL (Federal Firearms License)
Dealer, who then performs any local background checks. Dealers usually charge an average of $25 for a background check. The cost of a background check is NOT included in the Proguns.com invoice. WE
DO NOT SHIP TO NON-FFL HOLDERS, as per federal law.
Your local FFL also may charge a transfer fee, which is NOT included in the Proguns.com invoice.
As of February 1, 2005 the law allows us
to accept a faxed or scanned e-mail copy of your dealer's
signed FFL. If you have ordered from us through a dealer before,
it may not be necessary to resend a copy of their license.
Class 3 items can be shipped ONLY to Class 3 dealers.
We will not reimburse for loss of time,
late delivery, inconvenience, or loss of use.
Cancellations
All orders are able to be cancelled only
if the item has not been shipped. Items over
$1000.00 are subject to a $150.00 cancellation fee. There
will be a cancellation charge once we have approval to process
your order.
If your order has been processed, then
a 35% restocking fee applies. Although we will verify cancellation
with you through e-mail, we accept cancellations ONLY via
phone calls and/or registered mail. If you do not get an e-mail
from one of our agents verifying cancellation, then your order
has NOT been cancelled. WE DO NOT ACCEPT CANCELLATIONS ON
CUSTOM ORDERS.
Changes to Your Order
We will try to help you make changes to your order before
it ships. If you send us an e-mail requesting a change, please
save a copy as well as a copy of our reply. If you do not
receive a personal e-mail from one
of our agents, then your request has not been received and/or
read, and no changes will be made to your order.
Pricing
All descriptions and pricing of products on this website are subject to change without notice. Pricing of items is seldom inaccurate, but Proguns.com reserves the right to decline any order/transaction until pricing is corrected. Prior to credit card being charged, customers will be notified by email of any errors. Proguns.com is not responsible for email communication errors.
Specifications of products are from importers and manufacturers, and Proguns.com reserves the right to change all information provided. While Proguns.com makes every effort to ensure the accuracy of all pictures and descriptions, pictures and descriptions of items are often generic, and they may not match unerringly. Always consult the item’s written description.
Payment
Proguns.com accepts ONLY credit cards. To order online in
our store on our secure server, you must use a credit card.
Due to identity theft issues and Federal Export laws, Proguns.com does not accept orders from outside the United States.
