Transferable Machine Guns
Because the laws are so intricate and detailed,
many people are confused about machine guns and the legalities
of owning them. However, contrary to what many believe, it
is legal for civilians to own fully automatic weapons and
other NFA weapons, and these weapons include what are known
as transferable machine guns. The National Firearms Act does
not ban civilians from owning ALL fully automatic machine
guns; just those manufactured after 1986. Because the machine
guns legal for civilians to own are not new and are simply
changing ownership, they are known as transferable machine
guns.
The requirements to buy transferable machine
guns are quite similar to those for purchasing other firearms
such as handguns. The prospective buyer must fill out a form
4, fulfill certain requirements, and undergo a background
check, just as if he or she were purchasing a handgun or other
firearm. However, there is also a $200 tax on transferable
machine guns, which is paid each time one of these firearms
changes ownership.
It is important to note that though transferable
machine guns are legal to own by Federal law, certain states
prohibit their residents from purchasing or owning them, along
with other firearms and weapons. Check with your local laws
to make sure you can buy and own transferable machine guns.
